Car Accident in Carrollton, GA
Injury: Hand, Neck, and Back Injuries
Case Summary: This case arose from a serious T-bone collision in Carroll County, Georgia, when the driver of the vehicle in which our client was riding ran a red light and was struck in the intersection. Although our client was a passenger and did nothing to cause the crash, he suffered significant injuries to his hand, neck, and back. His medical bills exceeded $69,000.00, and his hand injury in particular had a major effect on his daily life and ability to work, leaving him unable to perform his job as he had before the collision.
What made this case especially challenging was that, in addition to the injury claim itself, the defendant filed a petition for declaratory judgment in the United States District Court for the Northern District of Georgia. That meant the case involved not only proving the extent of our client’s injuries and damages, but also fighting a separate federal court battle over coverage and legal responsibility. We litigated that issue aggressively, took multiple depositions, and pushed the case forward through extensive motion practice. Ultimately, the federal judge ruled in our favor and granted our motion for summary judgment.
That ruling was a major turning point and put us in a much stronger position to resolve the injury case. Once the declaratory judgment action was decided in our favor, we were able to move the case toward settlement and secure $260,000.00 for our client. The result reflects both the seriousness of the injuries and the importance of being prepared to fight on multiple fronts when the defense tries to limit recovery through separate court proceedings.
